This perspective is shared by financial expert Stefan Borson, who, in an exclusive interview with Football Insider, suggested that the governing body probably feels its stance was justified by the independent commission’s decision to impose two separate point deductions on the Merseyside club.
During the previous season, Everton faced charges for two violations of the profit and sustainability rules (PSR), resulting in a cumulative penalty of eight points deducted from their league tally. However, the Premier League’s efforts to recoup its full legal expenses from the PSR case, amounting to £4.9 million, have proven unsuccessful, as reported by The Times on September 4th.
Instead, Everton has been directed to reimburse only £1.7 million of the total legal bill, leaving the Premier League to absorb the remaining £3.2 million.
This outcome serves as a cautionary tale for the governing body, emphasizing the importance of maintaining proportionate and reasonable legal costs in future cases.
Borson elaborated on the situation, stating that a comprehensive review of the costs decision is necessary to fully grasp the rationale behind the Premier League being awarded only £1.7 million.
He acknowledged that while the Premier League’s nearly £5 million bill appears excessive, it’s a consequence of enlisting top-tier legal representation.
The governing body employed the services of Linklaters, one of the world’s leading law firms, along with equally prestigious barristers, which naturally incurs substantial fees.
The independent commission’s ruling essentially declared that the Premier League couldn’t claim the entire amount from Everton and would have to bear a portion of the costs themselves. Borson noted that this is a common occurrence in such legal proceedings.
He speculated that the Premier League might have anticipated recovering a larger portion of their expenses, given that the independent commission largely validated their position in the Everton case. Nevertheless, this outcome underscores the importance of maintaining reasonable and proportionate legal costs in future disputes.
